Terms of Service

These Terms govern your access to and use of jashby.com, the Jashby learning platform, and any services that link to these Terms (collectively, the “Services”). By using the Services you agree to these Terms, so please read them carefully. If you are using the Services on behalf of a company, you confirm that you are authorised to bind that company to this agreement. If you do not agree, you may not use the Services.
1. Who we are
Jashby is operated by Jashby (“we”, “us”, “our”). We are an Australian-based team and you can reach us at support@jashby.com for any questions or concerns.
2. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Services, whether you explore Jashby through a temporary guest session or by creating a full account. By accessing the Services you confirm that you meet this requirement and are legally able to enter into a contract.
3. Account & security
- You are responsible for maintaining the confidentiality of your login credentials.
- You must immediately notify us if you suspect unauthorised use of your account or any other breach of security.
- We may suspend or terminate your account if we believe it has been compromised or used in violation of these Terms.
- Guest sessions are tied to the device and browser where they were created, may have limited functionality, and can be removed at any time if we detect misuse or the session becomes inactive.
4. Acceptable use
You agree that you will not:
- Use the Services for any unlawful purpose or in breach of applicable regulations.
- Upload malicious code, interfere with the platform, or attempt unauthorised access.
- Copy, reverse engineer, redistribute, or resell the Services except where permitted by law.
- Create multiple accounts to abuse promotions or bypass limits.
- Use automated means (bots or scripts) unless explicitly permitted.
5. Intellectual property
All content, software, branding, and learning materials are owned by us or our partners and are protected by intellectual property laws. We grant you a non-exclusive, revocable licence to access the Services for personal or internal business use. You may not reuse or redistribute the content without written permission.
6. Subscriptions & billing
Some features may require a paid subscription. When you purchase a subscription you agree to the pricing, renewal period, and payment terms presented at checkout. Fees are non- refundable unless required by law. If payment fails we may suspend access until the charge is successful. Guest sessions do not include paid features; you must create a full account and complete payment to access subscription-only content.
7. Email marketing & communications
By creating an account you consent to receive transactional emails about your use of the Services. You can also opt in to marketing updates, tips, and offers. Every marketing email includes an unsubscribe link. We use Brevo (formerly Sendinblue) as our email delivery and marketing automation provider, and they process communications on our behalf in accordance with their security standards. Guest sessions receive only essential service notifications; marketing messages are sent after you convert to a full account and opt in. You can manage your preferences via the account page or by emailing support@jashby.com. We honour opt-out requests promptly and comply with CAN-SPAM, GDPR, UK PECR, and other applicable marketing regulations.
8. Privacy
Our Privacy Policy explains how we collect, use, and share personal data. By using the Services you acknowledge that your information will be handled in accordance with that policy.
9. Third-party services
Some features rely on third-party providers (for example, Google for authentication and analytics). Those services are governed by their own terms and policies. We are not responsible for third-party content or actions.
10. Warranties & disclaimers
The Services are provided “as is” and “as available”. We do not warrant that the Services will be uninterrupted or error free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the extent permitted by law, we will not be liable for any indirect, incidental, consequential, or punitive damages, or for loss of profits or data, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim arising from or relating to the Services is limited to the amount you paid to us in the twelve months preceding the event giving rise to the claim.
12. Indemnity
You agree to defend, indemnify, and hold harmless Jashby, its affiliates, and their respective officers, employees, and contractors from any claims or demands arising out of your use of the Services or your breach of these Terms.
13. Suspension & termination
We may suspend or terminate access for any breach of these Terms or for suspicious activity. You may stop using the Services at any time. Sections that by their nature should survive termination (including intellectual property, limitations of liability, indemnity, and dispute resolution) will continue to apply.
14. Changes to these Terms
We may update these Terms from time to time to reflect changes to the Services or legal requirements. We will post the new Terms on this page and update the “Last updated” date. If the changes are material we will notify you by email or through the Services. By continuing to use the Services after changes take effect you accept the revised Terms.
15. Governing law & disputes
These Terms are governed by the laws of the Commonwealth of Australia and, where applicable, the laws of the State of New South Wales. If a dispute arises, the parties will first attempt to resolve it amicably. If we cannot resolve the dispute within thirty days, it will be submitted to the exclusive jurisdiction of the courts of New South Wales, Australia.
